Terms of Service

Welcome to Four Measure. These Terms of Service ("Terms") are a binding agreement between you and FourMeasure, Inc. ("Four Measure", "we", "us", or "our") and govern your access to and use of the Four Measure mobile application and related services (collectively, the "Service"). "Terms and Conditions" and "Terms of Use" refer to these same Terms.
By creating an account, or by accessing or using the Service, you agree to these Terms and to our Privacy Policy and Community Guidelines, which are incorporated by reference. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority where you live (typically 18), you may use the Service only with the involvement and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf. By using the Service you represent that you meet these requirements and that you are not barred from using the Service under any applicable law. The Service is not directed to children under 13, and we do not knowingly allow them to register (see our Privacy Policy).
2. Your Account
To use most features you must create an account using an email address or phone number. You agree to provide accurate information and to keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at support@fourmeasure.com if you suspect unauthorized use. We are not liable for any loss arising from unauthorized use of your account.
3. The Service
Four Measure is a social music application that lets you, among other things, create posts and reviews about music, rate songs and albums, build a profile (including a "top items" list), follow other users, send direct messages, and optionally connect third-party music accounts (such as Spotify or Apple Music) to enrich your experience. We may add, change, or remove features at any time.
4. Third-Party Services and Music Providers
The Service integrates with third-party services, including music providers (e.g., Spotify, Apple Music) and other providers. When you connect or use a third-party service, you are also subject to that third party's terms and privacy policy. Four Measure does not control and is not responsible for third-party services, and we do not grant you any rights in third-party content beyond what those services allow. Your relationship with any music provider is between you and that provider.
5. Your Content
"User Content" means anything you post, upload, send, or otherwise make available through the Service — including posts, reviews, ratings, comments, messages, usernames, profile details, and images.
You retain ownership of your User Content. By making User Content available, you grant Four Measure a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (e.g., resize images), display, and distribute that User Content solely to operate, provide, and improve the Service and as permitted by your privacy settings. This license ends when you delete your User Content or your account, except (a) where the content has been shared with others who have not deleted it, and (b) for a reasonable period of backup retention or where we must retain it to comply with law.
You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate these Terms, our Community Guidelines, or any law or third-party right.
6. Acceptable Use
You agree to follow our Community Guidelines. Without limiting them, you may not use the Service to: violate any law or third-party right; post content that is unlawful, infringing, harassing, hateful, sexually exploitative of minors, or otherwise objectionable; impersonate others or misrepresent your affiliation; harvest or scrape data; transmit malware; interfere with or disrupt the Service; circumvent rate limits, security, or access controls; or use the Service to send spam. We have no tolerance for objectionable content or abusive users, and we may remove content and take action on accounts as described in Section 8.
7. Copyright and DMCA
We respect intellectual-property rights and expect you to do the same. If you believe content on the Service infringes your copyright, send a notice to our designated agent that includes the information required by 17 U.S.C. § 512(c)(3):

We will respond to valid notices, may remove or disable access to allegedly infringing content, and may provide a counter-notice process. We terminate the accounts of repeat infringers in appropriate circumstances.
8. Suspension and Termination
You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access, remove content, or limit features if you violate these Terms or our Community Guidelines, if required by law, or to protect the Service or other users. We may act on objectionable content and abusive users promptly, typically within 24 hours of becoming aware. Sections that by their nature should survive termination (including Sections 5–7 and 9–14) will survive.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT USER CONTENT IS ACCURATE OR RELIABLE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUR MEASURE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Four Measure and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.
12. Dispute Resolution and Governing Law
These Terms, and any dispute or claim arising out of or relating to them or to the Service, are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles, except to the extent that mandatory consumer-protection laws of the place where you live give you additional protections that cannot be waived.
Informal resolution first. Before bringing any formal claim, you agree to contact us at support@fourmeasure.com and give us a reasonable opportunity to resolve the matter. We will work with you in good faith, and most concerns can be resolved this way.
Jurisdiction and venue. If a dispute cannot be resolved informally, you and Four Measure agree it will be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts — except that either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or the security of the Service. Nothing in this section removes any non-waivable right you may have to bring a claim in the courts of your own country or state of residence where applicable law so requires.
13. Apple and Google App Store Terms
If you download the app from the Apple App Store or Google Play, you also agree to that store's terms, and the following apply: these Terms are between you and Four Measure, not Apple or Google; the store provider has no obligation to provide maintenance or support; to the extent permitted by law, the store provider is not responsible for the app or any claims relating to it; and the store provider is a third-party beneficiary of these Terms and may enforce them against you. Your license to use the app is the limited, non-transferable license described in these Terms (and, for Apple, the Apple Standard EULA where applicable).
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice (for example, in the app) and update the "Last updated" date and the version. Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree, stop using the Service and delete your account.
15. General
These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and Four Measure regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
